A young Ballybofey man tried to kick a Garda who was driving a patrol car after he was arrested.
Jason Deward, 22, was arrested after being caught by Gardai trying to kick in the door of a bar in Ballybofey at 5am on January 19th last.
When arrested Deward became aggressive and started to abuse Gardai.
He was put into the Garda patrol car but tried to kick the Garda driver while he was in the back passenger seat.
He also tried to spit at Gardai while in the patrol car.
Deward’s solicitor Niall Sheridan told the court that his client had a serious problem with alcohol.
He had previously broke both his legs after an accident and his plans to work with horses had been ruined.
The court heard that Deward had six previous convictions for various offences including being drunk and using threatening and abusive behaviour.
Judge Paul Kelly said he noted that Deward had been given a chance on previous occasions.
He adjourned the case until May 20th for a probation and community service report.
