EXCLUSIVE: A Donegal businessman has reacted furiously after the High Court overturned a previous court decision not to prosecute him for breaching the smoking ban at his pub.OLYMPUS DIGITAL CAMERA

Former Finn Harps footballer and owner of the Fisherman’s Inn bar, Maurice Toland, was prosecuted after HSE officials said the smoking room at his St Johnston pub breached regulations.

Environmental Health Officers claimed the structure was a room within a room because it is surrounded by four walls of the main premises.

The pub owners, St Johnston Taverns Ltd and directors Maurice and Ann-Marie Toland, were prosecuted under smoking ban legislation in Letterkenny District Court on February 2, 2011.

They denied it breached the ban and their architect gave evidence to the District Court that the smoking area was open to the elements and had been designed in such a way to let smoke out.

District Judge Seamus Hughes dismissed the case after finding that more than 50 per cent of the walls of the structure were open and therefore came within the exceptions for smoking areas as contained in the Public Health(Tobacco) Act 2002.

He also found that the distance between the four surrounding walls of the main pub to the walls of the smoking structure was immaterial.

However, he decided to state a case to the High Court in which its opinion was sought as to whether his findings were correct in law.

Today President of the High Court, Justice Nicholas Kearns, ruled that the smoking room at the Fisherman’s Inn did breach smoking regulations and upheld the HSE prosecution.

The owner of the Fisherman’s Inn, Maurice Toland, has reacted furiously to the decision of the High Court.

Mr Toland told Donegal Daily said it was a case of the ‘small-man losing again.’

The Donegal businessman estimated he has so far spent up to €12,000 on legal fees trying to maintain the smoking room at his premises.

But he admits he cannot appeal today’s decision of the High Court to the Supreme Court.

“The bottom line is that the HSE have unlimited funds and can continue to fight this case for as long as they choose.

“We won this case in both the district court and the circuit court and both judges agreed that we had complied with the law.

“However the HSE appealed it again because they have the power and the funds to do so and they have won.

“Once again the system has beaten the small-man, the self-employed person trying to make a living,” he said.

Mr Toland says he is unsure if he will be able to renovate the smoking room at his bar.

He says he met with officials from the Environmental Health Office on a number of occasions to discuss plans for the smoking area.

“My architect bent over backwards to comply with the building guidelines and two judges agreed that the room was perfectly adequate.

“And yet the HSE ignore these judges and are able to write a blank cheque to take it to the High Court.

“The only alternative I have is to tell my patrons to smoke out in the street at the front of the bar and I certainly don’t want that.

“It would not only look unsightly but it could lead to all sorts of anti-social behaviour,” he said.

Since the launch of the Donegal Diaspora website last week, the response from abroad has been very positive.

Evidence of this is the many comments left on the linked Facebook page from all corners of the globe.

Donegal County Council says it is delighted Donegal emigrants can connect with each other over a variety of different stories from all corners of the world.

The website recorded over three and a half thousand visits within a short period of its launch last week and the associated Facebook page has a total of over 500 likes, which reaches 135,000 people worldwide.

Speaking this week Michael O’hEanaigh, Director of Service with Donegal County Council said that “We are delighted with the positive response that we have received to www.donegaldiaspora.ie . Our Donegal friends and family are located all over the globe.”

The US and the UK record the highest number of visitors, nearly two thousand between them.

But the website has also been accessed from Russia, Vietnam, Jamaica, Nepal, the list goes on and on – all of these countries and many, many more have someone living there who is interested in, or has a connection to Donegal.

Now they can access a site that lets them know what is happening in the county, be it creative or business orientated; whether they are from Inishowen or Killybegs; whether they are interested in the Arts or in windsurfing – there is a story on the website which will interest them.

Adam took the snaps from Dunree.

Scientists believe 2013 could be a great year to see the Northern Lights over Donegal.

And that could see a repeat of the visits of tourists last year.

“The pictures are incredible,” said Jenny McNally from Inishowen Tourism.

“Adam’s photographs have been seen around the world. And every single frame shows off our county once again.”

DUBLIN COUNCILLORS CONDEMN CLLR McENIFF AS PROTEST PLANNED AT HOTEL

sean mceniffAnti- Racist Councillors in Dublin have added their voices to the condemnation of a Donegal Fianna Fail councillor for ‘racist’ comments made against Travellers – ahead of a protest on Saturday.

The widely publicised views expressed by Cllr Sean McEniff were followed by a malicious arson attack on a Council house allocated to an overcrowded Donegal traveller family. Protestors are to gather outside a hotel partly owned by Mr McEniff tomorrow.

Cllr Cieran Perry (Independent, Dublin City Council) said tonight “The deplorable comments made by Cllr McEniff created an atmosphere where cowardly thugs believe it is acceptable to burn a travellers home. This Irish form of racism is unacceptable.

“We feel it is important for elected representatives to express our abhorrence of the views expressed by Cllr McEniff and also Cllr Eugene Dolan of Fine Gael. This is not a local matter for Donegal, it is an important national issue.”

Cllr Louise Minihan (eirigi, Dublin City Council) said: “We are not living in Alabama in the 1950s, but it is clear some people wish we were. Cllr McEniff’s views must be clearly rejected by all decent public representatives. It is little wonder politicians are held in low esteem by the public if a small few pander to ignorant racism and prejudice in this way.”

Hannagh McGinley, a Traveler Rights Activist, said: “The Travelling community is one of the most socially marginalised and economically disadvantaged section of Irish society, and the unacceptable comments of both Cllr McEniff and Cllr. Dolan encourage further discrimination against our people. Elected councilors have a responsibility to represent all sections of their constituency.”

Micheál Cholm Mac Giolla Easbuig, Community Activist in Donegal said he will travel to Dublin for the protest.

“This is the most recent episode in a drama of racism. prejudice and exclusion, in which public representatives played leading roles. Cllr. McEniff’s and Town Cllr. Dolan’s racist statements regarding the Traveller community clearly inflamed the situation. I believe they have a case to answer in relation to incitement to hatred. The traveller groups in Donegal have expressed support for the protest.”

The group Anti-Fascist Action is co-ordinating a picket to be held on Saturday 16th February at 2pm at the Camden Court Hotel in Dublin, a property owned by Cllr McEniff.

AFA spokeperson Joanne Tobin said: ‘This Cllr McEniff condemned the arson attack, but without any recognition of the consequences of his racist statements. Hate Speech leads to Hate Acts. We have been contacted by dozens of people from community, anti-racist and political groups throughout the country who are very angry and want to make their views clear to Cllr McEniff.”

She added: “The organisers of the picket wish to make it clear that they have no argument with the staff of the Camden Court Hotel and that no animosity should be directed at them. Our protest is directed at Cllr Sean McEniff.”

 

DONEGAL BOXER QUIGLEY REALISES DREAM AS HE REACHES IABA ELITE FINALS

Donegal boxer Jason Quigley’s rapid rise up the boxing ranks continued tonight when he reached the final of the IABA Elite Championships.Jason-Quigley

The Finn Valley boxer had beaten London 2012 Olympian Darren O’Neill in the quarter-final last week.

And he went one step further at the National Stadium in Dublin by beating the highly-fancied Conrad Cummins from the Holy Trinity club in Belfast in his semi-final.

Quigley did it the hard way by coming from behind going into the last round to win 17-14 after both boxers had received public warnings.

But there was a huge cheer for the young Donegal boxer when he was given the decision.

Quigley, who boxed in the 75 kg category, will face the biggest fight of his career to date next weekend when he boxes in the final of the championships.

SAM IN LIFFORD 6DONEGAL Mayor Frank McBrearty has paid a glowing tribute to Jim McGuinness and the Donegal senior football squad at a ceremony in Lifford on Friday night.

Cllr McBrearty said the All-Ireland winners would inspire a new generation to take up sport.

“It is a fantastic achievement and so many young people have some fine role models to look up to,” said the Mayor.

“They have inspired a new generation and inspired so many other people with their achievements in recent years.”

Donegal manager Jim McGuinness thanked the council for the tribute and paid tribute to all his players and back room team who had brought Sam Maguire to Donegal in September.

Jim said five of the Donegal panel were still looking for jobs and he hoped they would get positions so they could continue their work on the pitch for the county.

He said Ryan Bradley, Anthony Thompson, Leo McLoone, Paddy McGrath and Eamonn McGee had put their lives on hold for Donegal.

“I would ask anyone here, if it is at all possible to get these solid men some relaibale employment. They need security and it would benefit our team,” he said.

Art O’Brien admitted he was still in shock when host Ryan Tubridy called him at home.

The Donegal man guessed St Valentine as the correct answer to last night’s public audience competition teaser.

And he picked up a cool €20,000 in cash for his troubles.

Host Tubridy asked Art if he had any plans to spend some of the €20,000 on.

Art replied “I’m still in shock to be honest. I’m not sure what I’m going to do with it.

“I have a 01 Nissan Micra so I might think about an upgrade.”

Ryan replied that there was probably a very happy car dealer in Co Donegal rubbing his hands already.

 


WIND FARM WARS: CONFUSING STATEMENTS FROM DEPARTMENT OVER STUDY

New windfarm THE Department of the Environment has clashed with Donegal environmentalists over a consultation study on the impacts of wind farms.

The Gweebarra Conservation Group had claimed that residents affected by wind farms and who were suffering health problems could email the Department which is conducting a review of rules surrounding wind farms.

The group says people suffering from ‘Wind Farm Syndrome’ could and should tell the Department.

A Department spokesman told Donegal Daily: “The Department of the Environment, Community & Local Government has initiated an open and transparent public consultation process on certain technical aspects of the 2006 guidelines and anybody or any other interested parties are entitled to make submission under this process.

“All submissions received under the process will be considered. We are not conducting an investigation in Donegal or any other county for that matter; we are engaged in a process to encourage the public or any other interested parties to participate in the process and get their point of view across whatever that might be.”

So the Department says it will study all submissions – including from people who have suffered health problems.

But it won’t investigate any of those claims.

In a strange intervention over the Gweebarra group’s claim, a group representing the powerful wind farm businesses then issued the following statement.

Kenneth Matthews from the Irish Wind Energy Association said: “I wish to respond to inaccuracies made about wind energy in your piece “Revealed:  Government Investigating ‘Wind Turbine Syndrome’ in Donegal”, published on 14 February 2013 on your website.

“IWEA believes that your article was a misrepresentation of the current Public Consultation underway by the Department of the Environment, Community and Local Government concerning the planning guidelines for wind farm developments. This is a focused and specific consultation in which all interested stakeholders were invited to put forward their views on any updates required to a number of sections of the current guidelines including noise and shadow flicker.

“The consultation has no remit to undertake canvassing of individual counties, such as Donegal, as your article suggests. This is a misleading suggestion that the Department has been involved in such activities when the consultation did not contain any provisions to undertake such a canvass.

“IWEA welcomes the opportunity afforded by the Department for all stakeholders to participate in this consultation. It is extremely important that unfounded allegations are addressed and the reality of what the consultation is seeking to do be stated.”

So the Department IS reviewing the guidelines surrounding wind farm development.

And the Department HAS taken submissions from people who say they have suffered health problems as a result of wind farms.

Donegal has been ear-marked for hundreds more wind turbines, including one near Glenswilly National School.

Last night Sinn Fein said it was backing wind farms across Ireland. The party also said communities should be consulted.

Donegal Daily does not accept the claims from the IWEA that our report from the Gweebarra Conservation Group was in any way inaccurate.

THE EXCHANGE PROJECT

The Family Resource Centre has been invited by the Playhouse in Derry to participate in an exciting cross-border and cross-community youth project for young people aged between 12 and 16 years of age.

 

Up to 150 young people from 5 youth projects in Donegal and 5 in Derry will be involved in developing a Urban Arts Project in each of their areas as well as each project ‘twinning’ with a project on a cross-border basis. The young people themselves will decide on their own Urban Arts Project, whether that might be animation, D-Jaying, mural painting, production of a DVD or a drama sketch.

A field trip to each of the community projects will take place at the end to celebrate the achievements.

 

The Exchange Project commences in March when youth leaders will undertake 30 hours of community arts training, followed by 8 weeks of contact time in each project with a professional community arts practitioner during April and May. In July the cross-border partnership work will take place while in August a 4 day Urban Arts Project will be developed with all 150 young people participating in the one location with the celebratory field trip taking place in September.

International Women’s Day

International Women’s Day held annually on 8th March is an International Day of Celebration where thousands of events are held throughout the world to inspire women and celebrate their achievements. Raphoe Family Resource Centre will be hosting a Coffee morning on Friday 8th March where there will be a display celebrating the lives of Women. More details to follow watch this space.

 

COUNSELLING SERVICES

Raphoe Family Resource Centre is now in a position to offer a free and confidential weekly counselling service to the general public. This person-centred service will be for those experiencing Bereavement/Loss, Separation, Abuse, Mental Health Difficulties and issues around sexuality. It will operate on an appointment basis only. Little Smiles with Big Dreams is a parent and toddler group that meet every Wednesday morning at 10.30am –12 noon in the Family Resource Centre. Anyone who is in care of a child where it be an aunt / uncle/ childminder or grandparent is welcome. The kiddies can get involved in Messy play, free play, story time and music time where the adult can enjoy a cuppa tea and meet other adults. Parent and Toddler are a great way to enhance your little one confidence and meet others their age. A light lunch is provided and a small cost of 50 cent per family.

RAPHOE BOXING CLUB

On Sunday next Raphoe’s female middle-weight Caroline Connolly will box in the finals of the National Senior Championships in Dublin when she is faces 3 times National Senior Champion, Sinead Kavanagh of Drimnagh Dublin in 75kgs division.

On Sunday evening last Raphoe boxers Keith Mc Kinney, Patrick Friel and Denis Lafferty were in action at a major tournament in St Mary’s Hall Convoy and Club coach Gary Mc Cullagh said he was over the moon with the performances of his three up and coming boxing stars.

On Sunday evening next Raphoe boxers, Liam Crawford, Charlie Mc Donagh and Denis Lafferty will be in action in Dunfanaghy when the local club play host to a highly rated Co. Roscommon select in the Osman Centre Dunfanaghy and this tournament gets under way at 3p.m. sharp. Raphoe boxing coach Gary Mc Cullagh is at an advanced stage with the match-making for the clubs major boxing show on Friday 15th March in the Cathedral Hall. More details of this tournament will appear in the press in the coming weeks.

Council’s Border Villages Social Integration Project’s Donegal Border Villages Website www.donegalbordervillages.com The website, which was launched by the Mayor of Donegal, Councillor Frank Mc Brearty will afford local community groups, organizations and individuals to access information on what is taking place in their local areas, and to upload information about events and activities on to the website. Staff from the Family Resource Centre have been trained to upload information so please feel free to contact the Centre on 074 9145796 or email raphoefrc@eircom.net.

VIEWPOINT: CAN PAY, MUST PAY – AND TIME TO SHUT UP AND PAY UP

This is a view from a reader in Falcarragh:

“I can stand it no longer. Not a day goes by without someone moaning on your website about austerity.

These people are the usual suspects. They’re on Donegal Daily complaining about household charges, water charges and God knows what next.

As someone who works up to 50 hours every week so me and my family can just keep going, I’m probably one of those who should be complaining when taxes go up.

Next the Government will tax fresh air.

But the fact is that I am subsidising a lot of the moaners out there who keep going on about how they’ve no money.

I see them every day; these moaners and begrudgers always going on about austerity. They are the ones who are in the pub five nights every week.

The moaners are just going to have to shut up and pay up. I’m fed up paying their way. It’s time they started to pay their own way.

And it’s time the silent majority of good decent people stood up and told them: Can Pay, Must Pay.

I hope Donegal Daily prints this view for a change.

St Patrick’s Day Celebration of Irish Culture, Burtonport.

It was agreed at a recent meeting that committee members would once again visit the local businesses in the Rosses area to request sponsorship in the form of prizes / financial donation etc… which are needed as prizes on the day. We hope to do this over the coming fortnight.

We would also be grateful to receive donations from any individuals in the community who feel that they may be in a position to donate something as a prize. Parish Retreat

The Parishes of Kincasslagh, Dungloe and Falcarragh have come together to organise a retreat in Ards to help us celebrate the Year of Faith.

It begins on Saturday 2nd March 2013., at 10.00 a.m. until 4.00 p.m. The theme is “Let there be Faith.” Conducted by Fr Kieron Shorten OFM Capuchin. The protest outside the Camden Court Hotel today

More than 60 people protested outside Dublin’s Camden Court Hotel today to highlight widespread anger at the recent comments against Travellers made by Donegal councillor Sean McEniff, a director of the hotel.

The picket lasted one hour and covered both entrances to the hotel, with support expressed by passing drivers and shoppers.

A large number of hotel staff and Gardai were present to observe the peaceful protest.

Cllr Cieran Perry, (Independent, Dublin) was joined by fellow councillors Louise Minihan, Mannix Flynn and Damien O’Farrell on the protest. Councillors Christy Burke, Anna Quigley and Vincent Jackson sent messages of support.Camden Court 4

Cllr Perry said ‘The disgraceful statements made by Cllr McEniff and Cllr Dolan, are openly racist and need to be opposed nationally as well as locally in Donegal. We will oppose Apartheid against Travellers wherever it is proposed. While the parties they are members of are clearly not interested in disciplining their representatives, we are showing that those pandering to ignorance and racism must face the consequences.’

Donegal community activist Micheál Cholm Mac Giolla Easbuig congratulated the protesters in Dublin today for taking a strong stand against the remarks made by Cllr McEniff and Cllr Dolan.

Mr Mac Giolla Easbuig said that he believes that this could be the start of a number of protests outside Cllr McEniffs Hotels around the Country.

Mr Mac Giolla Easbuig called again for Cllr McEniff and Cllr Dolan to do the right thing now and resign.

The Alliance the largest Registered Golf Society in the Country had the great pleasure to have a lovely spring like day for their visit to Rosapenna Sandy Hills at the week end. The weather was just lovely with very slight breeze and it stayed dry all day .The course was in excellent condition and the greens as usual fast and true.

In the Gross section Michael McGeady was going for 4 wins in a row had one of those days we all like to forget. The winner Keelan Quigg, who has not been on top of the podium this season in the Gross section until now produced a superlative round .The other winners this year have all been professionals in the shape of J.P.Dolan the pro at Ballybofey /Stranorlar and Brian McElhinney one of the pros at Foyle Golf Academy apart from Enda Kennedy who had won in Ballyliffin.

After the first nine Keelan was the one at the top of the leader board at level par. He had birdied the 1st dropped a stroke at the next went level for the next 4 holes birdied the par 3 7th parred the next and dropped a stroke at the 9 th .He then parred the 5 holes following, birdied the index 1 15th parred the 16TH a par 3, birdied the 17th par 5 and then closed his round with a bogey on the par 4 18TH He was one under and mighty pleased with himself as well he might be.

Brian McElhinney was one behind him after 9 as was Cathal Patton, Brian was playing par golf bar dropped shots on 9 and 10 all the other holes he played I regulation figures. Cathal had a bit of a stumble on 13 and 14 when he dropped 3 strokes but he rallied well to go top of the Nett Winners prize list

Brian was runner up in the Gross section on 2 over.

The runner up in the nett section was Seamus Herraghty He had local knowledge in abundance. ,he is a member of Rosapenna Golf club and was playing with the Green Keeper and how he tried to make these advantages pay off .He had a blank on the 5th but still had 19 points on the front nine to Cathal Patton’s 20 points ..After the 10th he was level with the winner and they matched each other until the 18th where Cathal got 3 points to Seamus’s 2 points and that was the difference between winning and losing.

In the Golfer of the Year Brian McElhinney secured the gross prize .He was steadiness personified throughout the Season and with one counting event to go he is in an unassailable position.

In the Nett the title of Alliance Champion has not been decided yet. It has been an interesting contest over the last few months as three members of the same family battle it out for the title. This week Maurice McGettigan is now just 1 point behind his brother Odran as he was the only one to secure a placing in the top ten this week. As a consequence he leap frogged his nephew to be in second place just behind his brother. His nephew is just 5 adrift of him .Odran who is the Alliance Champion from last year is on 27 Maurice on 26 and Connor on 21 and the title is in their hands as no one else can catch them. The last counting day is on Dunfanaghy. It promises be a real family shoot out.

ANOTHER PLAYER FROM DONEGAL TO GET A WINDFALL ON WINNING STREAK

shaunDONEGAL’S winning streak on Winning Streak continues.

Another player from Donegal will take part in next Saturday’s RTE gameshow after his name was picked out this evening.

Shaun Diver from Derrybeg will come home with at least €25k after next week’s show.

And if the 39-year-old Gaoth Dobhair man gets to spin the wheel, he’ll have a chance to scoop half a million euro.

Friends have been inundating Shaun with ‘good luck’ messages since his name was drawn during tonight’s edition of the show – the winner walked away with almost €80,000.

Celtic-mad Shaun – a stalwart of the local GAA club as well as Gweedore United – will appear on next Saturday’s programme.

Friends and family will travel to Dublin on Saturday morning for the recording of the show.

His appearance will be the 12th by someone from Donegal in just over a year.

“We’re delighted for Shaun,” said one friend tonight.

“Celtic beat Dundee Utd 6-2 today so he’s a very happy man.”

 

DERRY ROSE TO BLOOM AT LETTERKENNY’S ‘CALAMITY JANE’

Derry Rose Julianna Ayton will be centre stage in Letterkenny from February 26th to March 2nd when she joins the cast of Letterkenny Musical Society for their production of Calamity Jane at An Grianan Theatre.

The talented young Campsie woman has proved to be a real find for the LMS, who were quick to cast her in the role of Calamity after a stunning audition last September.

Since then, the entire cast has been working every week on the forthcoming production that’s certain again to be a show stopping success.   Donal and Niall

Famed for their amazing shows, including stunning productions of Oliver and Annie in recent years, Letterkenny Musical Society (LMS) has again pulled out all the stops with this year’s much-loved classic.

Under the keen eye of Director Billy Patterson and Producer Noel O’Donnell, the energetic and talented bunch of singers, actors and comedians have put together a version of Calamity Jane that nobody will want to miss.

The versatile and accomplished singer and actor Giles Murray, who has had a number of  Maire and Niallstarring roles with LMS over the years, plays Wild Bill Hickock, with Joe Harley taking on the role of Lieutenant Danny Gilmartin.

Although the stage show is similar in story to the well-known movie, there are many more musical and indeed visual treats in store for the audience, not least of which are the four can-can girls, who may well actually steal the show with their on-stage antics!

The much admired Adelaide Adams is gloriously portrayed by Nicola McBride, who played  the lead role as Nancy in Oliver last year, while her maid Katie Brown, who causes much confusion and finds herself in the Golden Garter in Deadwood as Adelaide Adams, is played brilliantly by Ríana Lynch.

Of course that isn’t the only case of confused identity in the show, and Donal Kavanagh is simply superb as Saloon owner Henry Miller, first thrown into a frenzy by the arrival of Francis and not Frances Fryer (expertly played by Niall McDonagh), and then by the revelation that Katie Brown is not, in fact, who his customers thought she was.

His fears are eased though by his niece Susan, a role mastered with ease by newcomer RattlesnakeMaire O’Donnell, who has demonstrated such talent in her first show with the group that she was also handed the demanding task of being Calamity’s understudy, too.

All of this is played out to the sounds of some of the most amazing musical harmonies you’re likely to hear in a stage show, harmonies once again creatively sewn together by musical director Gerard Bradley.

Throw in the humour and the vibrant dancing sensationally brought together by choreographer Maria Rushe and it’s easy to see that there’s a real treat in store in An Grianán Theatre next week.

FATHER OF TWELVE TOLD HE WOULD BE GOING TO HIS OWN FUNERAL

A father of 12 was told he would be going to his own funeral after being caught speeding out of a church carpark.New court

Gardai had to slam on their own brakes when Patrick Ward drove out of the Church of the Irish Martyrs in Letterkenny.

Garda Shane Lavelle, who was driving to work, told Letterkenny District Court he followed the silver Toyota Avensis car but it failed to stop at a Yield sign.

Garda Lavelle later contacted Mr Ward but he denied any wrongdoing on June 2nd, 2012.

Solicitor Rory O’Brien told the court that Mr Ward had ben attending a christening at the church and had been involved in an argument with a family member.

He left the church in haste, did not see the Gardai but accepts what he did, Mr O’Brien added.

The court was told Ward, of Tubbercurry, Co Sligo, who was charged with dangerous driving, had no previous convictions.

He added his client had four young children and needed his driving license to bring them to school.

Judge Paul Kelly warned Ward that he would be going to his own funeral if he continued to drive in the manner in which he did.

He fined Ward €250.
